The following are the Terms and Conditions applicable in respect of the Data Sim and Fibre Power Connection Bundle (“Bundle”) being provided to customers (“the Customer”) by Melita Mobile Ltd (“Melita”). Access to and use of this Bundle is subject to the following Terms and Conditions. 1. This Bundle will start from the 1st November 2011 and will continue thereafter unless and until stocks last and/or service is terminated by Melita.
2. This Bundle is available to all new Customers subscribing to the Data SIM and Fibre Power Connection services. Customers who terminated or were disconnected from their subscription to the Data SIM and/or Fibre Power Connection in the last three months are not eligible for this Bundle.
3. A Customer subscribing to this Bundle shall benefit from a subsidised tablet. Customers benefiting from this bundle will be required to pay three months in advance of the monthly tariff due for the Data SIM and Fibre Power Connection subscription and the subsidised price depending on the tablet chosen. The subsidised price of the tablet is invariable irrespective of the Fibre Power Connection subscription.
4. A Customer in order to benefit from this Bundle shall upon subscription enter into a twenty-four (24) month agreement with Melita (‘the ‘Agreement’)
5. The Agreement referred to in clause 4 shall commence on the date of acceptance by Melita and shall continue for a term of twenty-four [24] months (“the Initial Term”). The Customer can opt to terminate the Agreement on expiry of the Initial Term, by giving at least three [3] months prior notice in writing. If the Customer terminates the Agreement, disconnects any service before the lapse of the Initial Term, the Customer shall be liable to pay Melita an Early Termination Fee, which shall consist of (i) a one-time lump sum of the monthly subscription fees for the remaining duration of the term, and (ii) all outstanding amounts on the Customer’s bill.
6. After the Initial Term, this Agreement shall continue for further terms of one month each, until the Customer decides to terminate the Agreement by notice in writing at least two [2] weeks before the end of the then current one-month term.
7. Melita shall have the right to vary these Terms and Conditions at any time by giving you 30 days’ written notice of such amendments and such amendments shall automatically become part of these Terms and Conditions at the end of the said notice period. If you do not accept any such amendments, you have the right to terminate the service without incurring any penalty during the 30 day notice period. .
8. These Terms and Conditions should be read in conjunction with the Standard Terms and Conditions, the Data SIM Terms and Conditions, the Fibre Power Conditions of Service and any other relevant terms and conditions that apply, provided that in case of conflict between these Terms and or any other relevant terms and conditions, then these Terms and Conditions shall apply.
